Terms of Use

1. Acceptance of terms

By accessing or using SiteKD (the “Service”), you confirm that you are at least 18 years old, have authority to bind your business (if applicable) and accept these Terms and the Privacy Policy.

If you do not agree, you must not use the Service.

2. The Service

SiteKD provides website design, development, build and maintenance for clients worldwide from our London studio. Each project starts with an individual assessment and is agreed through a personal quote.

We may change, suspend or discontinue parts of the Service with reasonable notice where possible. We aim for reliable operation but do not guarantee uninterrupted availability.

3. Accounts and eligibility

You must provide accurate information and keep your access secure. You are responsible for all activity under your account or project.

We may suspend or terminate access for breach of these Terms, security risk, or unlawful or abusive behaviour.

If you provide a mobile number, you agree to receive transactional SMS related to the Service. Marketing SMS require separate consent, as described in the Privacy Policy.

4. Quotes, billing and payments

Each quote is prepared individually after assessing your needs. Price, scope, timelines and support terms are confirmed in writing in the quote or contract before work begins.

Payments are made as set out in the quote — typically a deposit before start and the balance on acceptance, unless otherwise agreed.

You authorise us and our payment processors to charge your chosen payment method for all applicable fees and taxes.

Non-payment may result in suspension of work or termination of support without refund of amounts already paid.

5. Trials and team seats (SiteKD Booking)

Some SiteKD Booking subscriptions start with a free trial. During a trial you may set up your business, hours and booking page without being charged for the trial period itself.

If you add a person to your team (or confirm a staff count that includes additional seats) while you are on a trial plan, the trial ends automatically at that moment. Billing then starts for your plan plus the number of people on your team, at the rates shown at checkout or in your account.

Confirming or activating your team size is your authorisation for us (and our payment processor) to end any remaining trial and charge the applicable subscription fees for your plan and team size. Seat counts and plan fees may change if you later add or remove team members.

6. Refunds and adjustments

Fees paid to SITEKD LTD are generally non-refundable once project work has begun, except where the law requires otherwise. Without limiting the above:

• Deposits for work already started are not refunded if you terminate without our agreement
• One-off design, development or migration fees are not refunded after a stage is accepted
• Support fees are not refunded for unused periods
• Payment disputes without prior contact at hello@sitekd.com may result in immediate suspension of the service

7. Ending support

You may end a support agreement with written notice to hello@sitekd.com. Thirty calendar days’ notice is required before the desired end date.

Termination stops future billing after the notice period expires but does not refund past payments.

After the service ends, terms from the original quote do not carry over. On renewal you receive a new individual quote under current terms and prices.

8. SMS and electronic messages

We may send you SMS, email and other messages about the project, quote and Service. You agree to use these channels in accordance with the law.

By using the Service and providing a phone number, you authorise SITEKD LTD to send transactional SMS. Marketing SMS require separate consent. See the Privacy Policy for opt-out.

9. Acceptable use

You agree not to:

• Violate applicable law or third-party rights
• Send spam, unlawful content or malware
• Attempt unauthorised access to systems or accounts
• Reverse-engineer, scrape or resell without permission
• Use the Service for fraud, deception or harm

10. Your content and data

You retain ownership of content you provide. You grant us a limited licence to host, process and display it solely to provide the Service.

You are responsible for compliance of your clients’ data. On termination we may delete data after a reasonable retention period, as described in the Privacy Policy.

11. Intellectual property

SiteKD, our brand, software and documentation are owned by SITEKD LTD or its licensors. These Terms do not grant you any rights beyond limited use of the Service.

After full payment, rights in the delivered website transfer as set out in the individual quote, unless otherwise agreed.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW.

We do not warrant that the Service will be error-free, uninterrupted or meet every business expectation.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITEKD LTD AND ITS DIRECTORS, EMPLOYEES AND SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFIT, REVENUE, DATA OR GOODWILL.

OUR TOTAL LIABILITY FOR A CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

14. Indemnity

You agree to indemnify and hold harmless SITEKD LTD from claims, damages and costs arising from your use of the Service, your content or breach of these Terms or applicable law.

15. Governing law and disputes

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules, except where mandatory local law requires otherwise.

Disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except where consumer law gives you non-waivable rights to bring proceedings in your country of residence.

16. Changes to these terms

We may update these Terms at any time. Updated Terms are posted on this page. Material changes may be notified by email. Continued use after they take effect means acceptance.
